Personal data protection in the European Union

The European Commission has released, on 4.11.2010, a Communication to the European Parliament, the Council, the Economic and Social Committee and the Committee of the Regions on personal data protection in the European Union. This communication intends to set up a strategy on how to protect individuals' data in all areas of the Union's activities, including law enforcement, while reducing red tape for business and guaranteeing the free circulation of data within the EU, and, at the same time, bearing in mind the challenges resulting from globalisation and new technologies.

The attempt to modernize the European Union legal system in what concerns data protection will allow the EU to remain a driving force in promoting high data protection standards worldwide.

This paper will aim at understanding the current legal framework and the changes and consequences that will derive from the intervention announced by this Communication.
